Terms of Service

The agreement between you and Elastova — including what the app is not.

1. Who you are agreeing with

These terms are an agreement between you and ELASTOVA (SMC-PRIVATE) LIMITED, a private limited company incorporated in Rawalpindi, Punjab, Pakistan.

"Elastova", "we" and "us" mean that company. "You" means you. Our full company details are at the end of this document.

By using Elastova, you agree to these terms. If you do not agree, please do not use it.

2. ⚠️ Elastova is not medical advice

This is the most important thing in this document.

Elastova is a private record-keeping and information tool. It is not a medical device, not a healthcare service, and not a substitute for a qualified clinician.

Elastova does not:

• Diagnose any condition
• Assess, measure or grade any medical condition
• Tell you whether you need surgery or any other treatment
• Predict whether your skin will change, tighten or improve
• Provide treatment, prescriptions or clinical recommendations

Always speak to a qualified doctor or clinician about your body and your health. Never delay seeking medical advice because of something Elastova told you, and never disregard advice a clinician has given you because of something Elastova told you.

If you think you have a medical emergency, contact your local emergency services immediately. Do not use Elastova.

3. The AI assistant, and its limits

Elastova includes an AI assistant. You should understand what that means:

• It can be wrong. AI models produce confident, fluent answers that are sometimes inaccurate, incomplete or outdated.
• It is not a clinician and has not examined you.
• It cannot see your medical records and does not know your full history.
• Do not rely on it for any decision that matters to your health. Use it to organise your thinking and prepare questions for a real clinician.

We do our best to make the assistant careful and honest, including about the limits of what is actually known about loose skin after weight loss. We do not guarantee that any particular answer is correct.

4. Who can use Elastova

You must be 18 or over. Elastova deals with sensitive information about adult bodies and is not appropriate for children.

You must also be legally able to enter into this agreement.

If we find out an account belongs to someone under 18, we will delete it.

5. Your account

You are responsible for keeping access to your account secure. Tell us at privacy@elastova.com if you think someone else has got into it.

You may connect more than one sign-in method to one account. Do not use someone else's sign-in, and do not let anyone else use yours — Elastova holds sensitive information about your body.

6. Your data is yours

You keep ownership of everything you put into Elastova: your words, your record, your photographs.

You give us permission to store and process it only so that we can run Elastova for you. That permission ends when you delete it.

We commit that:

• We will never sell your data.
• We will never use your data to train AI models, including your photographs.
• We will never use your data for advertising.
• We will never use it for anything other than providing Elastova to you.

How we handle your information is set out in our Privacy Policy and, for health information, our Consumer Health Data Privacy Policy.

7. Photographs

If you choose to add photographs:

• Only photograph yourself. Never upload images of another person.
• We strip face data, location coordinates and camera metadata before storing them.
• They are stored privately. They are not shown to other users, and there is no social or sharing feature in Elastova.
• We do not send your photographs to the AI model.
• You can delete them at any time.

8. Acceptable use

Please do not:

• Use Elastova for anyone other than yourself, or upload another person's images or health information
• Try to break, probe or gain unauthorised access to Elastova or its infrastructure
• Attempt to extract other users' data
• Use Elastova to provide medical services to other people
• Try to manipulate the assistant into producing harmful content
• Copy, resell or redistribute Elastova
• Use automated means to access the service at scale

We may suspend or close an account that does these things.

9. Deleting your account

You can delete your account and your data at any time from within the app. Deletion removes the account and its data from Elastova's live systems. Encrypted recovery backups may keep a copy for their limited recovery period, but our deletion safeguards prevent a restored copy from becoming an active account and require the deletion to be applied again before service resumes.

Our sign-in provider may retain your email address and security or audit records under its own terms. Deleting your Elastova account does not delete the record held by that provider.

A minimal record of the deletion itself survives, containing no health information, no name and no email. This exists to stop a deleted account being silently recreated by someone who later gains access to the same sign-in method. Our Privacy Policy explains this in section 8.

Deletion is permanent. We cannot recover your record afterwards.

10. Changes to Elastova

Elastova is early software and will change. We may add, alter or remove features. If we make a change that materially reduces what you get, or that changes how we handle your information, we will tell you in the app.

11. Availability

We aim to keep Elastova working, but we do not promise it will be available without interruption. It may be unavailable for maintenance, or because of problems at our suppliers.

Elastova is provided "as is". To the extent the law allows, we make no warranties that it will be uninterrupted, error-free, or fit for any particular purpose.

12. Limitation of liability

To the fullest extent permitted by law:

• We are not liable for any decision you make about your health, your body or any medical treatment. That is between you and your clinician.
• We are not liable for indirect, incidental, special or consequential loss.
• Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you have paid us in the twelve months before the claim, or USD 100.

Nothing in these terms limits liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not permit us to exclude.

13. Ending this agreement

You can stop using Elastova and delete your account at any time.

We may suspend or end your access if you break these terms, or if we stop operating Elastova. If we shut the service down, we will give you reasonable notice and a chance to get your data out first.

14. Governing law and disputes

These terms are governed by the laws of Pakistan, and the courts of Rawalpindi, Pakistan have jurisdiction over any dispute.

This does not remove any right you have under the consumer protection law of your own country or state, and it does not stop you complaining to your local regulator.

15. General

• If any part of these terms is unenforceable, the rest still applies.
• If we do not enforce something immediately, we do not lose the right to enforce it later.
• These terms, plus the Privacy Policy and Consumer Health Data Privacy Policy, are the whole agreement between us about Elastova.
• You may not transfer your rights under these terms. We may transfer ours if Elastova is acquired, and we will tell you if that happens.
